Our office is responsible for the collection of fees associated with Occupational Tax Licenses and Malt Beverage Licenses for businesses located in the unincorporated area of Bartow County. If your business is located within the city limits of any municipality, you must contact that municipality to obtain an occupational tax certificate. We now classify businesses based on the North American Industry Classification System or NAICS code. You can search the NAICS database to locate your code by clicking here.
E-Verify Requirements:. Pursuant to O.C.G.A. §36-60-6, every private employer with more than ten employees must register with and utilize the federal work authorization program. Requirements of this subsection will be effective on January 1, 2012, for employers with 500 or more employees; July 1, 2012, for employers with fewer than 500 but more than 100; and on July 1, 2013, for employers with fewer than 100 but more than 10. Applicants are required to complete one of the following affidavits based on your number of employees: Private Employer Affidavit of Compliance or Private Employer Exemption Affidavit.
Pursuant to O.C.G.A. §50-36-1(b), the Georgia Security and Immigration Compliance Act (SAVE), Bartow County Government is mandated to verify the lawful presence in the United States of any applicant. No license will be issued without proper completion of a Verification of Lawful Presence Affidavit. For a list of secure and verifiable documents please click here. Please note these requirements are not imposed by Bartow County Government.
For home based businesses, you must provide proof of residency via a drivers license or utility bill. Commercial applicants must provide a copy of lease agreement.
Section 36-6-60 of the Georgia Code requires that persons who are licensed by the state pursuant to Title 43 must present that state license when applying for an occupational tax certificate. For a complete listing of categories required to be licensed by the State of Georgia, please visit their website at www.sos.ga.gov/plb. You would also contact the Secretary of State's Office for information on forming a corporation. Individuals or entities doing business under a name different from the owner(s) full legal name(s) must complete a Trade Name Filing with the Clerk of Superior Court in the county where the business is principally located. If you incorporate your business with the Secretary of State, registering a corporate name does not control the use of fictitious or trade names, and issuance of a corporate name does not affect the commercial availability of the name
