Business Occupation Tax

WE'VE MOVED. WE ARE NOW LOCATED IN THE COMMUNITY DEVELOPMENT DEPARTMENT, SUITE 124 OF THE FRANK MOORE BUILDING.

Responsibilities
The Development Services section of the Community Development Department is responsible for the issuance of the Business Occupation Tax Certificates (commonly referred to as a business license) and several special sales or regulatory permits for all businesses located within Bartow County. Approximately 1,600 businesses are registered with Bartow County and their taxes are assessed and collected annually.

If the business is located with the city limits of one of the municipalities within Bartow County, the business will be registered with those cities.

We now classify businesses based on the North American Industry Classification System or NAICS code.  You can search the NAICS database to locate your code by

E-Verify Requirements:. Pursuant to O.C.G.A. §36-60-6, every private employer with more than ten employees must register with and utilize the federal work authorization program.  Applicants are required to complete one of the following affidavits based on your number of employees:
Private Employer Affidavit of Compliance (more than 10 employees)  or
Private Employer Exemption Affidavit (less than 10 employees)
Pursuant to O.C.G.A. §50-36-1(b), the Georgia Security and Immigration Compliance Act (SAVE), Bartow County Government is mandated to verify the lawful presence in the United States of any applicant. No license will be issued without proper completion of a Verification of Lawful Presence Affidavit. For a list of secure and verifiable documents please click herePlease note these requirements are not imposed by Bartow County Government.

For home based businesses, you must provide proof of residency via a driver's license or utility bill. Commercial applicants must provide a copy of lease agreement.

Section 36-6-60 of the Georgia Code requires that persons who are licensed by the state pursuant to Title 43 must present that state license when applying for an occupational tax certificate.  For a complete listing of categories required to be licensed by the State of Georgia, please visit their website at www.sos.ga.gov/plb.   You would also contact the Secretary of State's Office for information on forming a corporation.  Individuals or entities doing business under a name different from the owner(s) full legal name(s) must complete a Trade Name Filing with the Clerk of Superior Court in the county where the business is principally located.  If you incorporate your business with the Secretary of State, registering a corporate name does not control the use of fictitious or trade names, and issuance of a corporate name does not affect the commercial availability of the name.
